Taking the law into Their Hands
J.B. D’Souza

J.B. D’Souza was a distinguished bureaucrat and human rights activist.  In “Taking the Law into their Hands”, the author traces the history of judicial activism.

For the last two decades, the Indian courts have overcome their shyness.  They are showing their assertiveness.  The courts are working with punching ethics equity and justice.  They are dragging politicians to trial. It is a positive symptom.  Judicial activism is an international phenomenon.  The U.S. American Supreme Court has banned racial bigotry.

The Judicial thrust has become inevitable due to the indifferent attitude of the corrupt officials, police and elected representatives.  Today, judiciary can take up cases su motto even if no complaint is lodged.  Ofcourse, it may have some negative implications.  It may result in too many judicial investigations.  Courts might get flooded with litigations.  Their decisions may lead to doubtful legality.  Courts may even yield to temptations.
